Failure to Diagnose

Doctor reviewing Brain ScanIn essence this area deals with two distinct problems; a complete failure to diagnose a condition or a wrong diagnosis of an illness or injury.  In order to bring a claim in this regard the failure would have had to have lead to un-necessary pain and suffering or a worsening of your condition.

Examples of failure to diagnose could include a failure to identify a type of cancer or infection, alternatively it might be a failure to diagnose a fracture or injury or the removal of a perfectly healthy tooth.

If you have been the victim of a failure to diagnose and this has lead to a delay in your recovery or a worsening of your condition then you may be entitled to compensation.
